What is the New Car Lemon Law?

Generally, each state’s New Car Lemon Law protects buyers or lessees of new vehicles that have substantial defects affecting safety, value, or usability. If the manufacturer was unable to fix the problem in a reasonable time you may qualify for cash or a full repurchase.

New York

To qualify under New York Lemon Law, the following conditions typically apply:

The vehicle was purchased or leased in New York, or is currently registered in New York.
The vehicle is used primarily for personal purposes.
Repairs occurred within 24 months or 18,000 miles (whichever comes first).
The dealer or manufacturer has been unable to repair the vehicle in a reasonable amount of time – 30 days total or 4 times for the same repair with the problem persisting.

New Jersey

To qualify under New Jersey’s Lemon Law, the following conditions typically apply:

The vehicle was purchased or leased in New Jersey, or is currently registered in New Jersey.
Repairs occurred within 24 months or 24,000 miles (whichever comes first).
The dealer or manufacturer has been unable to repair the vehicle in a reasonable amount of time – 20 days total or 3 times for the same repair with the problem persisting.
The manufacturer has been given a final repair attempt.

Pennsylvania

To qualify under Pennsylvania’s Lemon Law, the following conditions typically apply:

The vehicle is currently registered in Pennsylvania.
The vehicle was purchased in Pennsylvania or purchased in another state then first registered in Pennsylvania.
The vehicle is used primarily for personal purposes.
Repairs occurred occurred within 12 months or 12,000 miles (whichever comes first).
The dealer or manufacturer has been unable to repair the vehicle in a reasonable amount of time – 30 days total or 3 times for the same repair with the problem persisting.
